Your Rights in India

India offers multiple tiers of consumer protection for insurance policyholders. Here's what you need to know.

🏛️

The Regulator: IRDAI

The Insurance Regulatory and Development Authority of India (IRDAI) regulates all insurance companies under the Insurance Act, 1938 and IRDA Act, 1999. IRDAI's Protection of Policyholders' Interests Regulations, 2017 mandate that insurers must settle or reject claims within 30 days of receiving all documents. Insurers must give clear, written reasons for any denial and inform you of your right to appeal.

⚖️

The Insurance Ombudsman

India has 17 Insurance Ombudsman offices across the country, established under the Insurance Ombudsman Rules, 2017. The Ombudsman handles complaints up to INR 50,00,000 (50 lakhs) and the service is completely free. The Ombudsman's recommendation is binding on the insurer. You must first file a complaint with your insurer and wait 30 days or receive a rejection before approaching the Ombudsman.

⏱️

Appeal Deadlines & Timeline

Internal grievance: Insurers must acknowledge within 3 working days and resolve within 15 days (as per IRDAI IGMS guidelines). Ombudsman filing: You have 1 year from the date of the insurer's rejection to file. The Ombudsman must give a recommendation within 3 months. If unsatisfied, you can escalate to Consumer Forums (District, State, or National Commission) with no upper monetary limit.

📊

Consumer Forums & IGMS

The IRDAI's Integrated Grievance Management System (IGMS) lets you lodge complaints online at igms.irda.gov.in. Beyond the Ombudsman, India's Consumer Protection Act, 2019 gives you access to Consumer Dispute Redressal Forums at district, state, and national levels. These forums can order compensation beyond the claim amount, including for mental agony and harassment. No lawyer is required to file.
