Common Renewal Disputes in Indian Health Insurance

1. Premium Loading After a Claim

Your insurer increases your premium significantly at renewal — sometimes 30–50% or more — citing the claim you made in the previous policy year. This is called risk loading and is regulated by IRDAI.

Your rights: Insurers can apply loading, but the amount must be actuarially justified and disclosed upfront in the product's filed premium structure. Arbitrary, punitive loading that exceeds the insurer's filed rates is challengeable.

2. No-Claim Bonus (NCB) Forfeiture

You made a claim this year and your insurer reduces or eliminates the NCB you accumulated over several claim-free years.

Your rights: Most policies allow NCB forfeiture after a claim year — this is typically a legitimate policy term. However, if the claim was partially paid or the denial was disputed, the forfeiture may be challengeable. Also, if you ported to a new insurer, the NCB from the old policy should transfer.

3. Denial of Portability Rights

You tried to port your policy to another insurer but the receiving insurer denied your portability application or applied waiting periods as if you were a new customer.

Your rights: Under IRDAI's Health Insurance Portability Regulations, you have the right to port to any insurer without a fresh waiting period for conditions where the waiting period was already served under your previous policy. The new insurer must:

  • Accept your portability application
  • Credit the waiting period already served (PED and specific disease waiting periods)
  • Not reduce the sum insured you were covered for previously

4. Non-Renewal of Policy

The insurer refuses to renew your policy — citing claims history, age, or change in health status.

Your rights: Under IRDAI regulations, health insurance policies must be renewable for lifetime (no upper age limit for renewal) for products approved after 2013. Insurers cannot refuse renewal solely on the basis of claims history. They may apply loading — but cannot deny renewal.

5. Continuity Benefit Disputes

You have maintained the policy for many years, but at renewal the insurer disputes your continuity — claiming a lapse (even a brief one during which you were within the grace period) to restart waiting periods.

Your rights: A grace period of 30 days is standard in most policies. Treatment taken during the grace period is covered. A renewal processed within the grace period maintains full continuity — waiting periods do not restart.

6. Downgrade of Coverage Without Notice

The insurer discontinues the product you were on and "migrates" you to a replacement product with less coverage, higher co-payment, or lower sum insured, without adequate disclosure.

Your rights: IRDAI requires insurers to offer migration to a product of equal or better coverage when a product is withdrawn. You also have the right to migrate to a different insurer (portability).

IRDAI Portability: Step-by-Step

Porting your health policy in India:

  1. File portability application at least 45 days before renewal of your current policy (this is a hard deadline — do not miss it)
  2. The new insurer has 15 days to accept or decline
  3. If declined, you can challenge the refusal at IRDAI IGMS
  4. All waiting periods already served carry over — the new insurer cannot restart them
  5. Your NCB should transfer as a discount or enhanced sum insured, depending on the new insurer's portability terms

Challenging Premium Loading

For loading disputes:

  1. Request the specific actuarial basis for the loading percentage applied
  2. Request the insurer's filed loading structure with IRDAI for your product
  3. If the loading exceeds the filed rate, file on IRDAI IGMS immediately
  4. Compare with other insurers' rates for similar risk profiles — if the loading is disproportionate, the Ombudsman can award relief

Step 1: Internal Grievance

Write to the insurer's Grievance Redressal Officer. For renewal disputes, timing matters — if you are challenging loading or a coverage change, do so before paying the renewed premium if possible, to preserve your options. If you pay the loaded premium under protest, note "paid under protest pending grievance resolution" in your communication.

Step 2: IRDAI IGMS

File at igms.irda.gov.in for:

  • Portability application rejections

  • Non-renewal refusals

Step 3: Insurance Ombudsman
