Unum Claim Denied: Your Complete Guide to Appealing

Unum denied your disability claim? This complete guide covers why Unum denies claims, your ERISA rights, appeal deadlines, and what evidence you need to win.

Unum Claim Denied: Your Complete Guide to Appealing

Receiving a denial letter from Unum is stressful and often feels like the end of the road. It is not. Unum denies a substantial percentage of disability claims, and a meaningful number of those denials are overturned on appeal. Understanding the denial landscape — why Unum denies claims, how the appeal process works, and what evidence reverses denials — puts you in a much stronger position.

Who Is Unum?

Unum Group is one of the largest disability insurance companies in the United States and the United Kingdom. It provides group long-term disability (LTD), short-term disability (STD), life insurance, and supplemental benefits primarily through employer-sponsored plans. Because most of these plans are governed by ERISA, claimants have specific rights and specific limitations when challenging a denial.

Unum has also been the subject of significant regulatory scrutiny. In 2004, Unum reached a $15 million multi-state settlement with insurance regulators from 49 states and the District of Columbia over systemic claims-handling abuses, including denying valid disability claims through improper use of medical reviewers, unreasonable document requests, and other bad-faith tactics. The company agreed to create a Special Committee and reopen thousands of denied claims for re-evaluation.

Why Unum Denies Claims

Understanding Unum's typical denial playbook is essential for building your appeal.

Lack of objective medical evidence. Unum's in-house medical reviewers frequently state that while the claimant has a diagnosis, there is insufficient objective evidence to support the degree of functional impairment claimed. This rationale is especially common for chronic pain, fibromyalgia, autoimmune conditions, depression, anxiety, and PTSD.

Conflicting physician opinions. Unum uses its own network of reviewing physicians who often disagree with your treating doctor. Unum's reviewers are paid by Unum and have financial incentives aligned with denial.

Surveillance footage. If private investigators capture footage of you performing activities that Unum believes are inconsistent with your claimed limitations, the footage will be used to support denial or termination of benefits.

Functional Capacity Evaluation results. A one-day FCE administered by an Unum-selected therapist may produce findings that suggest you can perform sedentary or light work. These findings are frequently disputed by treating physicians and vocational experts.

The any-occupation shift. After 24 months of own-occupation benefits in most group LTD policies, Unum reviews whether you can perform any occupation suited to your education and experience. Many claims are terminated at this transition.

Paper reviews without examination. Unum's reviewing physicians often render opinions solely by reviewing records — without ever examining the claimant. Courts have increasingly scrutinized this practice, particularly when the paper reviewer contradicts the opinions of physicians who have direct patient relationships.

Your ERISA Rights After a Unum Denial

If your Unum policy is through your employer, ERISA governs your claim and your appeal. ERISA provides:

Your denial appeal window is closing.
Most insurers require appeals within 30–180 days of denial. After that, you lose your right to contest. Start your free appeal now →

Right to your claim file: Under 29 C.F.R. § 2560.503-1, you are entitled to a complete copy of your claim file at no charge. Request it immediately — the file often contains internal medical reviews, surveillance records, vocational analyses, and nurse case manager notes that you can directly challenge.

180-day appeal deadline: ERISA requires at least 180 days from the date of the denial letter to submit an administrative appeal. Check your denial letter carefully — some Unum plans state a shorter deadline.

Right to non-conflicted reviewer: Your appeal must be reviewed by a person or committee not involved in the initial determination.

The 2016 DOL Regulations: Under regulations finalized in 2016 and effective for plans from April 2018, Unum must provide you with any new evidence or new rationale it develops during the appeal process before issuing a final decision. You then have the opportunity to respond before the record closes.

Right to External Independent Review: Complete Guide" class="auto-link">external review: In many states, after exhausting the internal appeal, you have the right to an independent external review.

Right to sue under § 502(a): If the internal appeal is denied, you may file suit in federal court. The court will generally review only the administrative record — making it critical to build a complete, compelling record during the appeal itself.

What Evidence Overturns Unum Denials

Winning appeals share a common pattern: comprehensive, specific, and coordinated evidence.

  • Treating physician RFC assessment: Your doctor's detailed assessment of your specific physical and cognitive limitations on a sustained basis — not just a diagnosis.
  • Specialist records: Neurologist, rheumatologist, psychiatrist, orthopedic, or other specialty documentation corroborating your functional limitations.
  • Objective test results: MRI, CT, EMG/NCS, neuropsychological testing, pulmonary function tests — whatever is relevant to your condition.
  • Vocational expert report: Demonstrates that, given your specific limitations, no jobs exist in the national economy that you could perform reliably.
  • Social Security Disability award: A strong indicator of total disability that Unum cannot simply ignore.
  • Personal statement: A detailed narrative of your daily functional limitations, including the impact on cognitive function, concentration, pain, fatigue, and activities of daily living.
