Cancer Treatment Denied in the UK: How to Appeal

Cancer treatment denied in the UK? Learn about the NHS Cancer Drugs Fund, NICE approval, private insurer PPO appeals, and FOS complaints. Full guide.

In the United Kingdom, most cancer care is delivered through the NHS at no direct cost to the patient. But this does not mean denials are uncommon. Whether you are navigating the NHS Cancer Drugs Fund, challenging an NHS funding refusal, or fighting a private insurer that has declined a claim for premium cancer care, understanding the system is essential to winning your appeal.

How Cancer Treatment Is Funded in the UK

NHS cancer care: The NHS provides cancer diagnosis, surgery, chemotherapy, radiotherapy, and palliative care free at the point of use. Oncology drug funding is governed by NICE (National Institute for Health and Care Excellence). If NICE has issued a Technology Appraisal recommending a drug for a specific indication, NHS England is legally obliged to fund it within 90 days of the recommendation.

Cancer Drugs Fund (CDF): Drugs that show promise but lack full NICE approval may be funded through the CDF while further evidence is gathered. Oncologists can access CDF drugs through the NHS England Blueteq system. If your oncologist recommends a CDF drug, it should be available without an additional cost to you — but access depends on your oncologist registering appropriately and NICE having included your specific indication.

Private health insurance: Many people supplement NHS care with private health insurance to access shorter waiting times, private rooms, and in some cases drugs not yet available on the NHS. Private insurers — including Bupa, AXA Health, Aviva, and Vitality — apply their own coverage rules and can deny claims for cancer treatment.

Time-sensitive: appeal deadlines are real.
Most insurers require appeals within 30–180 days of denial. After that, you lose your right to contest. Start your free appeal now →

Common Reasons Cancer Claims Are Denied in the UK

  • NICE has not approved the drug for your specific indication: Even if a drug is on the CDF for lung cancer, it may not be funded for a different tumour type.
  • Individual Funding Request (IFR) rejected: NHS Integrated Care Boards (ICBs) can fund treatments outside NICE guidance through IFR processes, but these are often denied on clinical or cost grounds.
  • Private insurer exclusion for cancer: Some private policies exclude pre-existing cancers or have lifetime limits on cancer claims.
  • Treatment deemed experimental: Private insurers routinely decline claims for treatments not yet included in NICE guidance or standard oncology guidelines.
  • Out-of-network specialist: If you see a consultant not recognised by your private insurer, the claim may be denied even if the treatment itself is covered.

How to Appeal an NHS Cancer Drug Denial

Step 1 — Ask your oncologist to apply for CDF access: If a drug is on the Cancer Drugs Fund list, your oncologist can apply for funding through the Blueteq system. This is a clinical process, not an administrative one — push your oncologist to do this if they have not already.

Step 2 — Individual Funding Request (IFR): If the drug is not on the CDF, your oncologist can submit an IFR to your ICB. The IFR must demonstrate that your case is clinically exceptional compared to others with the same condition. You or your oncologist can request the ICB's appeals process if the IFR is refused.

Step 3 — NHS Complaints Procedure: If you believe you have been denied a service you are entitled to, submit a formal complaint to the NHS trust, GP practice, or ICB. The Parliamentary and Health Service Ombudsman (PHSO) handles unresolved NHS complaints at the final stage.

How to Appeal a Private Insurer Cancer Denial

Step 1 — Internal PPO appeal: All UK private health insurers must have an internal complaints and appeals process. Submit your appeal in writing, include your oncologist's clinical justification, and cite relevant NICE guidelines.

Step 2 — Financial Ombudsman Service (FOS): If your insurer does not resolve the complaint within 8 weeks (or issues a "final response"), you can escalate to the FOS free of charge. The FOS can require insurers to pay claims, reverse exclusions, and award compensation for distress.
