Why Insurers Deny Claims in Germany

Germany's insurance landscape splits between GKV (statutory public health insurance covering ~90% of residents) and PKV (private health insurance). GKV denials typically involve treatment not in the standard benefit catalog (Leistungskatalog), off-label drug use not meeting G-BA (Gemeinsamer Bundesausschuss) criteria, or medical necessity disputed by the MD (Medizinischer Dienst). PKV denials commonly cite pre-existing condition exclusions, treatment costs exceeding covered amounts, or foreign treatment not covered.

How to Appeal

Step 1: Request written denial with full justification

Ask in writing for the specific VVG section or tariff clause cited, the medical basis for any medical necessity decision, and a copy of the insurer's internal review. In German: "Ich bitte um eine schriftliche Begründung der Ablehnung meiner Leistung unter Angabe der genauen Vertragsklauseln."

Step 2: File a formal written objection (Widerspruch)

For GKV, you have 4 weeks from the denial notification to file a Widerspruch. State your policy or membership number, dispute the specific grounds for denial, attach supporting medical evidence, and request reconsideration within 14 working days. Send via Einschreiben mit Rückschein (registered mail with return receipt) — critical for preserving deadlines.

Step 3: Request the MDK review report (GKV)

For GKV denials based on medical necessity, request a copy of the MD (Medizinischer Dienst) review report. You can challenge the MD's opinion with your physician's documentation and, if unfavourable, request an independent second opinion. The MD must base its conclusion on clinical evidence — unsupported assessments can be challenged.

Step 4: Versicherungsombudsmann or PKV Ombudsmann

After exhausting internal appeal, file with the appropriate ombudsman. For private insurance (non-health), apply to Versicherungsombudsmann e.V.
