Why Insurers Deny Claims in Germany

How to Appeal
Step 1: Request written denial with full justification
Ask in writing for the specific VVG section or tariff clause cited, the medical basis for any medical necessity decision, and a copy of the insurer's internal review. In German: "Ich bitte um eine schriftliche Begründung der Ablehnung meiner Leistung unter Angabe der genauen Vertragsklauseln."
Step 2: File a formal written objection (Widerspruch)
For GKV, you have 4 weeks from the denial notification to file a Widerspruch. State your policy or membership number, dispute the specific grounds for denial, attach supporting medical evidence, and request reconsideration within 14 working days. Send via Einschreiben mit Rückschein (registered mail with return receipt) — critical for preserving deadlines.
Step 3: Request the MDK review report (GKV)
For GKV denials based on medical necessity, request a copy of the MD (Medizinischer Dienst) review report. You can challenge the MD's opinion with your physician's documentation and, if unfavourable, request an independent second opinion. Step 4: Versicherungsombudsmann or PKV Ombudsmann
After exhausting internal appeal, file with the appropriate ombudsman. For private insurance (non-health), apply to Versicherungsombudsmann e.V. Step 5: Sozialgericht (Social Court) for GKV

Step 6: BaFin complaint
If you believe the insurer is systematically violating regulations, file a complaint at bafin.de/beschwerde. BaFin (Bundesanstalt für Finanzdienstleistungsaufsicht) can investigate and take enforcement action against non-compliant insurers.
