Why Insurers Deny Claims in Uganda
Before mounting an effective appeal, you need to understand the specific basis for the denial. Ugandan insurers rely on a predictable set of grounds that can often be successfully challenged.
Policy exclusions. Insurers frequently rely on specific exclusion clauses in the policy to deny claims. Common exclusions in Uganda include pre-existing medical conditions in health and life policies, driving under the influence in motor policies, use of a vehicle outside its insured purpose, and acts of war or civil commotion. The scope of exclusion clauses must be construed strictly under Ugandan contract law.
Non-disclosure of material facts. Uganda's insurance law incorporates the common law duty of utmost good faith (uberrimae fidei). Insurers deny claims — particularly in life and health lines — alleging the policyholder failed to disclose a material fact at application. However, for non-disclosure to void a policy, the fact must have been material and the non-disclosure must have been deliberate or reckless. Innocent omissions are generally not sufficient.
Late notification. Most policies require notification of a loss within a specified period. Missing this window — even briefly — can be invoked as grounds for denial. However, IRA Uganda's regulatory framework requires insurers to demonstrate actual prejudice from late notification before relying on it as a basis for full rejection.
Insufficient documentation. Police reports, medical certificates, hospital invoices, death certificates, and other supporting documents are routinely required. Gaps in documentation are a leading reason for claim rejection, but these are often correctable on appeal.

Valuation disputes. The insurer may agree liability but offer a settlement significantly below the actual loss, citing depreciation tables or its own assessor's valuations. This is a common tactic that can be challenged with independent evidence.
How to Appeal a Denied Insurance Claim in Uganda
Step 1: Get the Denial in Writing
Demand a formal written denial from the insurer specifying the exact policy clause, exclusion, or factual basis for rejection. If you received only a verbal denial, this is the mandatory first step before any other action is possible.
Step 2: Review Your Policy Against the Denial Reason
Read your full insurance policy carefully, including the insuring clause, definitions section, exclusions schedule, and claims notification requirements. Insurers sometimes misapply exclusions, rely on ambiguous wording that should be construed in your favor, or overlook endorsements that extend coverage.
Step 3: Gather Supporting Evidence
Compile a complete evidence file: your insurance policy and premium payment receipts, all claim correspondence and the denial letter, medical records and hospital invoices for health or life claims, police or incident reports for motor or theft claims, photographs of damage, and any independent expert or assessor reports.
Step 4: Submit a Formal Internal Complaint to the Insurer
Write a formal complaint to the insurer's claims department or senior management. Reference your policy number, the claim number, and the denial date. Clearly state why the denial is incorrect, cite the relevant policy provisions, and attach all supporting evidence. Request a written response within 15 business days. Step 5: File a Complaint with IRA Uganda
If the internal complaint is not resolved satisfactorily, escalate to the Insurance Regulatory Authority of Uganda. IRA Uganda can investigate complaints, direct insurers to pay valid claims, impose financial penalties, and in serious cases recommend licence suspension.
