Insurance Claim Denied in Ukraine? How to Appeal

Ukraine-specific guide to appealing denied insurance claims. Learn your rights under Ukraine insurance law and the regulator complaints process.

If your insurance claim has been denied in Ukraine, you have legal rights to challenge that decision. Ukraine's insurance market is regulated by the Національний банк України (NBU — National Bank of Ukraine), which assumed oversight of the insurance sector in 2020 under the "Split Law." Whether your denied claim involves private health insurance, life coverage, property, auto (OSAGO compulsory motor third-party liability), or travel insurance, Ukrainian law gives you a structured path to appeal — and the NBU provides a consumer complaint mechanism that can apply meaningful pressure to insurers who act unfairly.

Why Insurers Deny Claims in Ukraine

Several denial patterns are common across Ukraine's insurance market and should be anticipated when preparing your appeal.

Pre-existing condition exclusions are frequently applied by health and life insurers. Under Ukrainian insurance law, the insurer must demonstrate that the non-disclosed condition was material and that the policyholder had actual knowledge of it at the time of application. Suspicion or general risk factors are not sufficient grounds for denial.

Misrepresentation or non-disclosure claims allow insurers to void policies or deny claims if they allege the policyholder provided inaccurate information on the application. These allegations must be substantiated — an insurer cannot use minor or immaterial inaccuracies to avoid paying a valid claim.

Policy exclusions applied too broadly. Ukrainian policies routinely exclude certain events, conditions, or causes of loss. Insurers sometimes apply these exclusions to situations that fall outside the intended exclusion language. Review the exact exclusion wording against the facts of your claim.

Documentation or procedural grounds. Claims are denied for incomplete documentation, failure to notify the insurer within specified timeframes, or non-compliance with procedural requirements. Some of these denials are avoidable and can be overcome by demonstrating substantial compliance or the absence of prejudice to the insurer from any minor procedural deviation.

Disputed cause of loss. In property and auto claims, insurers dispute whether the damage falls within a covered peril or attribute the loss to an excluded cause such as wear and tear, owner negligence, or an uncovered event.

How to Appeal an Insurance Claim Denial in Ukraine

Step 1: Obtain Your Written Denial and Review the Policy

Your insurer must provide a written explanation of the denial, specifying the policy clause or legal basis for the decision. Request this in writing if you have not already received it. Review your insurance contract (страховий договір) and general conditions (загальні умови страхування) against the stated denial reason. Identify whether the denial is based on policy language, factual dispute, or procedural grounds.

Step 2: Gather Your Supporting Documentation

Compile all documentation relevant to your claim: your insurance policy and application, the denial letter, medical records or expert assessments, receipts and invoices for losses incurred, photos or other evidence of the insured event, and any prior communications with the insurer. For health claims, ensure you have treating physician documentation using appropriate diagnostic codes under Ukraine's adapted ICD-10 classification system.

Step 3: File a Formal Written Complaint with the Insurer

Under Ukrainian insurance law and the NBU's requirements, you are entitled to a formal internal review of your denied claim. Submit a written complaint (скарга) to the insurer's complaints department or management, clearly stating the grounds for your disagreement, attaching supporting documentation, and requesting a written response within the statutory review period.

Step 4: Submit a Complaint to the NBU

If the insurer does not resolve your complaint satisfactorily, file a complaint with the Національний банк України (NBU). The NBU has authority to investigate insurance companies for violations of consumer protection obligations, improper claim handling, and non-compliance with Ukrainian insurance law. Complaints can be filed through the NBU's consumer protection portal at bank.gov.ua. The NBU will contact the insurer on your behalf and investigate whether proper procedures were followed.

The Ліга страхових організацій України (LSOU — Insurance League of Ukraine) at uainsur.com is Ukraine's principal insurance industry association and can provide guidance and sometimes mediation assistance. For higher-value claims, engaging a Ukrainian attorney specializing in insurance disputes is advisable — particularly given the complexity of Ukrainian insurance law reform underway since the adoption of the new Insurance Law (Law No. 1909-IX, adopted 2021).

Step 6: Pursue Civil Court Action

If administrative remedies are exhausted, Ukrainian civil courts have jurisdiction over insurance contract disputes. Courts apply the Civil Code of Ukraine (Цивільний кодекс України) and the Law of Ukraine on Insurance (Закон України "Про страхування"). Legal action is a realistic option for significant claims and may be necessary if the insurer refuses to engage in good faith.

  • Your full insurance contract including general conditions and any endorsements or riders
  • All documentation submitted with the original claim — and any additional supporting evidence gathered since
  • Treating physician letters or independent expert assessments addressing the insurer's specific denial reasons
  • Records of all communications with your insurer, including dates, names, and content of telephone or written exchanges
