California: California Insurance Code Section 10144.51 and Health & Safety Code Section 1374.72 require coverage of behavioral health treatment, including ABA, for ASD. However, if Kaiser's wait time for ABA services exceeds state access standards (in California, behavioral health appointments must be available within 10 business days for non-urgent cases), Kaiser must authorize outside providers.
Telehealth ABA denials: Following COVID-19 telehealth expansions, telehealth ABA (particularly caregiver training via telehealth) has strong evidence support. Kaiser cannot deny telehealth ABA as "not medically necessary" if it is clinically appropriate and comparable to in-person services.
