Ping An Insurance (Group) Company of China is one of the world's largest insurance companies and China's biggest non-state-owned insurer. Why Ping An Denies Claims

The key legal protection: under Article 16 of China's Insurance Law, Ping An has only two years from policy inception to investigate and void the policy based on non-disclosure. After two years, Ping An generally cannot deny on non-disclosure grounds unless fraud was involved.
Non-disclosure or misrepresentation (未如实告知). If information was omitted or incorrectly stated on the insurance application, Ping An may attempt to void the policy or deny the claim. Under Article 16, the insurer's right to void the contract is extinguished after the two-year contestability period. Even within the first two years, the insurer's duty to inquire specifically about material conditions may limit their ability to rely on a general non-disclosure defense.
Waiting period (观察期). Health and critical illness policies in China have waiting periods typically ranging from 90 to 180 days for illness-related claims. Claims arising during this period are typically denied. If Ping An is misapplying the waiting period — calculating it from the wrong date or applying it to the wrong claim category — this can be challenged.
Policy exclusions and their enforceability. Specific treatments, procedures, or circumstances listed as excluded in the policy terms may be cited as the basis for denial. Under Article 17 of China's Insurance Law, exclusion clauses are unenforceable unless Ping An adequately explained them to you at the point of sale. If the exclusion was buried in fine print or not specifically drawn to your attention by the agent, argue Article 17 explicitly.
Ambiguous policy terms. Under Article 30 of China's Insurance Law, any ambiguous or unclear policy terms must be interpreted in a manner favorable to the policyholder. If the policy language supporting Ping An's denial is unclear or capable of multiple interpretations, the interpretation favoring coverage should apply.

Documentation gaps. Claims may be denied because submitted documentation was incomplete — missing hospital discharge summaries, diagnostic reports, itemized medical bills, or other required claim documents. Providing complete documentation often resolves these denials without a formal appeal.
How to Appeal a Ping An Denial
Step 1: Obtain the Written Denial and Review Your Policy
Request a written explanation if Ping An did not provide one. Compare the denial basis against your specific policy contract (保险合同) — particularly the coverage clauses, exclusion clauses, definitions, and any riders. Identify whether the stated reason is factually accurate under your specific policy language.
Step 2: File a Formal Complaint with Ping An
Call Ping An's national customer service hotline at 95511, use the Ping An Pocket (平安口袋) app, file through pingan.com, or visit a branch office. Submit a written complaint with your policy number, claim reference, a specific statement of why the denial is incorrect (with policy clause references), and all supporting documentation. Under Chinese regulations, Ping An must acknowledge and respond to policyholder complaints within a specified timeframe.
Step 3: Escalate to the NFRA at 12378
If Ping An's internal process does not produce a satisfactory outcome, escalate to the National Financial Regulatory Administration (NFRA) via the 12378 hotline, through nfra.gov.cn, or at your local NFRA bureau. The 12378 hotline is the dedicated insurance complaint line that is monitored by regulators — insurers are required to respond to complaints referred through this system.
Step 4: Invoke Article 17 — Duty to Explain Exclusions
If the exclusion Ping An is relying on was not clearly explained at the time of sale, explicitly argue this in your complaint: "Under Article 17 of the Insurance Law of the People's Republic of China, Ping An's agent was required to clearly explain this exclusion clause at the time of policy sale. No such explanation was provided. Therefore, this exclusion clause is unenforceable as applied to my claim."
Step 5: Seek Industry Association Mediation
Contact the local China Insurance Association (中国保险行业协会) branch and request referral to the insurance dispute mediation committee. This free mediation process can resolve disputes faster than regulatory proceedings or litigation and produces binding settlement agreements when both parties agree.
Step 6: File Civil Litigation
If all other avenues are exhausted, file a civil lawsuit in the People's Court (人民法院) with jurisdiction over the dispute. Chinese courts have ruled in favor of policyholders in numerous Ping An disputes, particularly where Ping An relied on exclusions that were not adequately disclosed at the point of sale (violating Article 17) or where policy language was genuinely ambiguous (Article 30).
