Late or incomplete notification of loss. Italian insurance contracts require prompt notification of a loss event (denuncia del sinistro) within the contractually specified timeframe. Failure to notify may reduce or eliminate coverage, though courts have mitigated this consequence where the insurer was not prejudiced by the delay.

How to Appeal a UnipolSai Claim Denial

Step 1: File a Formal Reclamo with UnipolSai

Under IVASS Regulation No. 24 of 19 May 2016, UnipolSai must maintain a documented complaints (reclami) procedure and respond within 45 days. File your reclamo by PEC (Posta Elettronica Certificata) or raccomandata A/R to UnipolSai's designated complaints office. Your reclamo should: identify yourself and your policy; describe the denial and why it is incorrect; reference the specific policy clause in dispute; attach all supporting documentation; and request a written response within the regulatory 45-day deadline.

Step 2: Escalate to IVASS

If UnipolSai does not respond within 45 days or maintains its denial without adequate justification, file a complaint with IVASS. Under Legislative Decree No. 209 of 7 September 2005 (Codice delle Assicurazioni Private), IVASS has supervisory authority over all Italian insurers including UnipolSai. Complaints are submitted online at ivass.it or by registered mail to IVASS - Servizio Tutela del Consumatore, Via del Quirinale 21, 00187 Roma. IVASS investigates complaints, contacts the insurer, and can impose sanctions for regulatory violations.

Step 3: Use the Arbitro Assicurativo

Italy established the Arbitro Assicurativo as an Alternative Dispute Resolution (ADR) mechanism for insurance disputes. For disputes involving amounts up to €15,000 (and in some cases up to €100,000), the Arbitro Assicurativo provides a faster, lower-cost alternative to civil litigation. Step 4: Pursue Mandatory Mediation Before Litigation

Under Legislative Decree No. 28/2010, mediation is a compulsory precondition for filing a civil insurance lawsuit. Contact an accredited Organismo di Mediazione (the Ministry of Justice maintains a registry) to initiate the mediation process. If mediation fails, you may proceed with civil litigation before the competent Tribunale.

Step 5: For RC Auto Disputes — Use the Conciliation Commission

For RC Auto disputes involving personal injury or significant property damage, the Italian Conciliation Commission (run through the insurance industry association ANIA) provides an additional conciliation pathway that many policyholders find more accessible than court.

Step 6: Appoint a Perito for Property Disputes
